Living Wage Program
Two companion ordinances were enacted to support the purpose of the Living Wage Ordinance:
Contractor Standards Ordinance (Page 6 of San Diego Municipal Code Division 32) (PDF) is intended to verify a bidder is capable to perform the contract and has the business integrity to justify award of tax dollars. Further details are provided in Rules for Awarding Contracts over $50,000 (PDF).
- Applies on all City contracts and subcontracts greater than $50,000.
- Contractor submits Pledge of Compliance (PDF), signed under penalty of perjury, stating firm's:
- financial resources;
- technical qualifications;
- material, equipment, and expertise to carry out the work;
- satisfactory record of performance; and
- satisfactory record of compliance with applicable statutes and regulations.
- Contractor must notify City within 15 days if government investigates firm.
- Violations may result in material breach of contract or contractor declared as non-responsible.
Service Worker Retention Ordinance (San Diego Municipal Code Division 28) (PDF) is intended to minimize disruption in services when contractors are changed and give incumbent employees a reasonable opportunity to obtain possible employment with a new contractor. Further details are provided in Rules for Worker Retention for Services over $25,000 (PDF).
- Applies on City service contracts greater than $25,000 with a term of more than 90 days; does not include professional service contracts, construction, or purchase/lease of goods.
- Terminated contractor provides employee information to new contractor and new contractor retains these employees for a 90-day transition period.
- Violations may result in termination of contract.
- Employee alleging violation of Service Worker Retention Ordinance may bring a private cause of action in state court against contractor.
