Solid Waste Local Enforcement Agency Hearing Panel

Duties

The independent hearing panel is required by State law to hear appeals from solid waste decisions the enforcement agency makes regarding inspections, permitting, and enforcement activities.

Appointment

Appointed by Council and confirmed by Mayor.

Term

A member of an independent hearing panel shall serve for a term of four (4) years and may not serve more than two (2) consecutive terms. If a member does not complete the member's term, the chairperson of the governing body (Council President) shall appoint a replacement to serve out the remainder of the unexpired term.

Composition

Three (3) members. Members of the independent hearing panel shall be selected for their legal, administrative, or technical abilities in areas relating to solid waste management. At least one (1) member shall be a technical expert and at least one (1) member shall be a representative of the public at large. Not more than one (1) member of the governing body shall serve on the hearing panel.
