Board Of Building Appeals And Advisors

Duties

Investigate and advise as to the suitability of any alternate material design, or construction method, and recommend reasonable interpretations of the provisions of the code. Conduct, public hearings upon, and recommend to City Council, the passage of new legislation pertaining to design and construction of buildings.

Appointment

Appointed by the Mayor and confirmed by the Council.

Term

Two-year staggered terms and until their successors have been appointed and qualified. The expiration date of all terms shall be March 1, however, not more than five terms shall expire in any year. During March of each year the Mayor may designate one member as Chairperson; however, in the absence of such designation, the Board shall, on or after April 15, select from among their members a Chairperson. Appointments to fill vacancies shall be for the unexpired term. Ten members limited to a maximum of eight (8) consecutive years in office and an interval of four (4) years must pass before such persons can be reappointed.

Composition

Ten (10) members who are qualified by experience and training to pass upon matters pertaining to design and construction of buildings, fire prevention, and fire protection. At least two members shall be licensed by the State of California as Civil Engineers, one of whom is duly authorized to use the title "Structural Engineer," and one member each shall be from the electrical and mechanical industries or professions. At least two members shall be licensed by the State of California as Fire Protection Engineers. At least one member shall be licensed by the State of California as an Architect. At least one member shall represent the disabled community. Each member is prohibited from engaging in any activity which could result in conflict of interest and must make an annual statement of financial disclosure.

The Director of Development Services, the Chief of San Diego Fire-Rescue Department and the City Attorney shall be ex officio members of the Board. The Planning Director shall be an ex officio member of the Board in matters pertaining to historic buildings. The Director of Development Services or his appointed representative shall act as Secretary to the Board.
