Consent Agenda

9 items fill the consent agenda including a resolution to rescind San Diego City Council Resolution No. 76068. During World War II, the San Diego City Council unanimously approved Resolution No. 76068, which called for the exclusion of Japanese Americans from the San Diego area. The resolution corresponded with President Franklin Delano Roosevelt signing in 1942 Executive Order No. 9066, under which more than 120,000 people of Japanese ancestry were incarcerated in ten concentration camps through the Western U.S. and Arkansas during World War II. 

With today’s City Council committed to equity and civil rights and liberties, it is more important than ever that the Council, as the resolution states, “officially rescind Resolution 76068 apologize to all people of Japanese ancestry for its past actions in support of the unjust exclusion, removal, and incarceration of Japanese Americans during World War II, and for its failure to support and defend the civil rights and civil liberties of Japanese Americans during this period.

 

Proclamations

Item 30 – Archives Month recognizes the great work of our City Clerk’s Office which manages archives serving as the classification, preservation, and conservation in excavation artifacts and public records that demonstrate enduring value.

 

Item 31 – Aids Walk and Run San Diego Day celebrates the event which raises money to empower people to take charge of their sexual health and well-being, educate, engage and provide services.

 

Item 32 – Romulo “Rom” Sarno, Jr. Day honors and veteran and volunteer who has made a major impact on the building of the international cottages in Balbo Park.

 

Item 33 – Naval Base San Diego Centennial Celebration celebrates the naval facility which has served its country while also grown in partnership with the San Diego community.

 

Item S500 – La Jolla High School 100th Anniversary Day celebrates the school’s major milestone, its alumni, teachers and staff throughout its century of providing education and more.

 

Item S501 – San Diego Open Week recognizes the sporting event which brings some of the world’s top players to compete at the Barnes Tennis center.

 

Item S502 – Positive Movement Foundation Day honors the organization which works directly with community schools to provide their students with school supplies and laptops, education workshops, academic scholarships, mentorship, tutoring, and empowerment events to support the growth of future generations.

 

Item S503 – Black Family Empowerment Day celebrates the event which honors and promotes black families, youth development, positive role models and opportunities.

 

Item S504 – Homeownership Equity Day recognizes the event which prepares eligible buyers of color, increases access to financial products and assistance and expands connections to qualified professionals.

 

Item S506 – Public School Recognition Day celebrates San Diego’s strong system of public education which fosters diverse learning opportunities and makes them available for all.

 

Item S507 – National Public Lands Day celebrates the connection between people and green space in their community, inspires environmental stewardship, and encourages usage of open space for education, recreation, and health benefits

 

Item S508 – The Charter School of San Diego Day recognizes the school which has been committed to collaborative efforts to improve the quality of life for students, their families, its employees, and the community at large.

 

Item S511 – Dystonia Awareness Month reminds people of the devastating disease which affects nearly 300,000 people in the United States.

 

 

Discussion Agenda

Item 509 -  Second Amendment to As-Needed Agreement with Schwartz Semerdjian Cauley & Evans LLP to Provide Continued Legal Services as Panel Outside Counsel - The City of San Diego currently has an as-needed agreement with the law firm of Schwartz Semerdjian Cauley & Evans as one of the City’s retained panel counsel to provide legal services in "Business and Financial Affairs.”  The City Attorney’s Office seeks approval of a Second Amendment to this legal services agreement with Schwartz Semerdjian to increase the total not-to-exceed amount to $1,100,000 from $750,000.

Item 330 - City of San Diego Affordable Housing Fund Fiscal Year 2022 Annual Report – The City of San Diego Affordable Housing Fund Fiscal Year 2022 Annual Report (Attachment 1) covers the period of July 1, 2021, through June 30, 2022, which reflects the Fiscal Year of the City of San Diego and the San Diego Housing Commission. It is issued following closeout of the Fiscal Year and includes unaudited data.

The report includes:

 

• Revenue collections and investments




• Performance in meeting the goals of the previous year’s Affordable Housing Fund Annual Plan




• Information regarding the number and types of units assisted




• Rents and sales prices of units assisted




• The amount of other funds leveraged

 

Item 332 - Informational Item Regarding the Fiscal Year 2022 Consolidated Annual Performance and Evaluation Report (CAPER) for U.S. Department of Housing and Urban Development (HUD) Programs – This informational item will provide the City Council with a summary of the Fiscal Year 2022 Consolidated Annual Performance and Evaluation Report (CAPER), which highlights the projects and programs the City implemented during the period of July 1, 2021 through June 30, 2022, using funds from the following federal sources: Community Development Block Grant (CDBG) program, HOME Investment Partnerships Program (HOME), and Emergency Solutions Grants (ESG) program.

 

 

 

Item S505 – Water Pass Through Rate Adjustments – This item would adjust water rates as to match in increase in the wholesale cost of water charged the San Diego County Water Authority.

 

 

Discussion Agenda

Item 331 - Amendment to the Municipal Code and Council Policies for Capital Improvements Program (CIP) and Infrastructure Process Improvements and Streamlining – This action will authorize amendments to the San Diego City Municipal Code in order to accommodate the growing budget, contract sizes, and workload for capital improvements. The action will also update Council Policy 000-31 on Transparency to ensure that streamlining measures are paired with enhanced transparency and accountability.

 

Item S510 - Consideration of a Nominee for Appointment to the Franchise Compliance Review Committee - On June 21, 2022, the City Council of the City of San Diego voted to establish the Franchise Compliance Review Committee. This Review Committee consists of five members: three appointees selected by the City Council and two appointees selected by the Mayor. Using Council Policy 000-13, the City Council may appoint the remaining two seats as selected by the City Council to the Franchise Compliance Review Committee.  One nomination was received by the revised September 15, 2022 deadline, in which Council President Sean Elo-Rivera and Councilmember Marni von Wilpert jointly nominated Jared Quient. This is a Council-only appointment
