Item 1 – Approval of Committee Minutes
Item 2 - Authorization to Execute a Second Amendment to the Contract with SBCS Corporation for Administration of the "No Shots Fired" Gang Related Gun Violence Reduction Program
The San Diego Police Department requests approval to execute the First Amendment to the contract with SBCS Corporation dba South Bay Community Services (SBCS) for the administration of the “No Shots Fired” gang-related gun violence reduction program.
This request is for approval to amend the contract with SBCS to extend the two-year agreement for an additional three one-year optional terms and to increase the not-to-exceed compensation amount by $750,000 for a total not-to-exceed amount of $1,250,000.
Item 3 - Second Amendment to the Agreement between the City of San Diego and Tegsco, LLC dba AutoReturn to provide Management and Dispatching for Towing Services
The City of San Diego requests approval to enter into a Second Amendment to the Agreement with Tegsco, LLC doing business as (dba) AutoReturn, now AutoReturn Holdings, Inc. dba CFKAA Holdings, LLC to extend the agreement term for one additional year for a total of eight years. CFCAA Holdings, LLC provides the software application and management of the Computer Operated Towing Dispatch Center for the towing services provided by contracted Licensed Tow Providers (LTP) and Licensed Impound Providers.
This is a cost-neutral program because the cost of CFKAA Holdings, LLC services is offset by the Tow Dispatch Fee collected on behalf of the City by Licensed Impound Providers from registered owners.

Item 4 - Proposed Amendments to the City of San Diego’s Earned Sick Leave and Minimum Wage Ordinance to Enhance the City’s Ability to Combat Wage Theft
This item requests that the City Attorney’s Office work with Council District 5 to develop amendments to the City of San Diego’s Earned Sick Leave and Minimum Wage Ordinance (MWO) to
- Give the City standing to seek damages on behalf of aggrieved employees under the City’s MWO,
- Authorize the City to bring misdemeanor charges against employers who commit wage theft in violation of the City’s MWO, and
- Permit aggrieved employees and the City to recover for unpaid overtime wages under the City’s MWO.

Item 1 – Approval of Committee Minutes
Item 2 - Agreement with JEB Sand and Gravel to Furnish City Departments with Trench Restoration Fill Materials
This item requests authorization to execute an agreement with Runts Trucking Inc., Doing Business As (DBA) JEB Sand and Gravel. The Contract provides services to the City of San Diego Public Utilities, Stormwater, and Transportation Departments, to furnish the City with decomposed granite, crushed rock, fill sand, topsoil and aggregate materials.
This fill is necessary to complete trench work and restore roadways and other areas throughout the City to a safe and reliable condition. The amount not to exceed (NTE) of this five-year contract is $57,155,000.
Item 3 - Proposed Update to Council Policy 400-04 Emergency Storage of Water
Council Policy 400-04 (CP 400-04), the Emergency Storage of Water, was initially adopted by City Council in 1963 and was last updated in 1973. The policy establishes a minimum quantity of stored, untreated water to provide for emergencies such as aqueduct failure or aqueduct pump station outage. This item proposes updates to CP 400-04 to bring the policy in alignment with emergency water storage needs.
Item 4 - Amendments to Chapter 6, Article 4, Divisions 1, 2, 3, and 5 of the Municipal Code all related to the Industrial Wastewater Control Program
The Public Utilities Department’s Industrial Wastewater Control Program (IWCP) regulates and permits industrial discharges to the City’s wastewater system to protect wastewater treatment, water reclamation, and advanced water purification facilities.
The IWCP enforces provisions of the San Diego Municipal Code (SDMC) to ensure compliance with federal and local pretreatment standards. The San Diego Regional Water Quality Control Board (RWQCB) and the U.S. Environmental Protection Agency (EPA) routinely inspect the IWCP to verify compliance with the National Pretreatment Program.
During a prior RWQCB inspection, the City was directed to update specific portions of the SDMC to align with current federal and State regulatory requirements. The City has and continues to be in compliance with federal and state regulatory standards under current operations and now will have those standards codified in the municipal code.
Item 5 - Establishing the Third Franchise Compliance Review Committee
This item would adopt a resolution establishing a Franchise Compliance Review Committee to oversee the Electric and Gas Franchise agreements with San Diego Gas & Electric for the compliance period of July 8, 2025, to July 7, 2027.

Item 6 – Adoption of the 2025 Urban Water Management Plan (UWMP) and the 2025 Water Shortage Contingency Plan (WSCP
This item would adopt the 2025 Urban Water Management Plan and the 2025 Water Shortage Contingency Plan in compliance with the Urban Water Management Planning Act and California Water Code (§10610-10656 and §10608 et seq.).
As part of the California Urban Water Management Planning Act (Act) and the California Water Code (§10610-10656 and §10608 et seq.), an urban water supplier must prepare, adopt, and submit an Urban Water Management Plan (UWMP) and Water Shortage Contingency Plan (WSCP) to the California Department of Water Resources (DWR) every five years.
The Act requires urban water suppliers servicing 3,000 or more connections or supplying more than 3,000 acre-feet (AF) of water annually to prepare a UWMP, which must analyze and describe the water supplier's service area, water demands and supplies, water conservation activities, energy intensity, and water supply reliability over a 20-year planning time frame. The Water Shortage Contingency Plan must identify actions the City may take in the event of a declared emergency or water shortage.
Item 7 - Amendment to Chapter 6, Article 7, Division 38 of the San Diego Municipal Code
The Public Utilities Department (PUD) is requesting the adoption of an ordinance to amend one division of the San Diego Municipal Code (SDMC) to better align with current planning practices and the incorporation of new state water conservation regulations as dictated by the California Water Code.
The following sections of the SDMC will be updated as followed: the Emergency Water Regulations (SDMC Chapter 6, Article 7, Division 38) will be updated to better align with the City’s Water Shortage Contingency Plan (WSCP) and will also now include the regulatory requirements established by Assembly Bill 1572 and California Water Code §10608.12.
Item 8 - Mission Bay Park Improvements Program
This action requests approval of the Mission Bay Park Improvements Program, certification of the Final Program Environmental Impact Report (PEIR) (SCH No. 2024100048), and adoption of the Findings, Statement of Overriding Considerations, and Mitigation Monitoring and Reporting Program.
The Mission Bay Park Improvements Program implements Section 55.2 of the City Charter by identifying projects funded through the Mission Bay Park Improvement Fund to develop, repair, and reinvest in assets within the Mission Bay Park Improvement Zone. These projects address water quality and circulation, habitat restoration, and visitor-serving improvements, as required by San Diego voters through the approval of Proposition C in 2008 and Measure J in 2016.

Item 9 - Public Power Feasibility Study - Phase II Report
The City of San Diego is conducting a multi-phased feasibility study to evaluate the processes, costs, risks, and opportunities associated with establishing a public agency to take on electricity delivery infrastructure assets of San Diego Gas & Electric (SDG&E) within the City.
Following a competitive procurement process, the City retained the services of NewGen Strategies & Solutions LLC (NewGen) to assist in the review and development of the Public Power Feasibility Study. The Phase I Report of the multi-phase, multi-year process was presented in July 2023 and included:
- process maps outlining the City’s decision points
- an analysis of options for municipal utility governance
- preliminary acquisition, severance, and operational costs
The Phase II Report builds upon the Phase I report and reflects substantial refinements in data quality and detail, and, in turn, an improved understanding of the potential financial feasibility, risks, and changing regulatory landscape.
Item 10 - SDG&E Franchise Independent Audit Report and Franchise Compliance Review Committee Report (2023 – 2025)
In July 2021, City Council adopted Ordinances O-21327 and O-21328 (Franchise Ordinances) awarding the 20-year Electric and Gas Franchises to San Diego Gas & Electric (SDG&E) for 10 years, with an automatic 10-year renewal if no separate action is taken by Council.
Section 6 of the Franchise Ordinances requires an independent audit to occur every two (2) years, addressing SDG&E's fulfillment of the financial, operational, documentary, and cooperative requirements under the Franchise.
Section 6 of the Franchise Ordinances also outlines the creation of the Franchise Compliance Review Committee (FCRC), which is established for the purpose of receiving the independent auditor's findings and incorporating them into an FCRC report with recommendations to City Council.
This item provides an overview of the Independent Auditor’s Report, which reviews SDG&E’s performance under the franchise agreements, as well as the FCRC’s report and recommendation on the potential renewal for the second 10-year term of the Franchise.
