The People's Business - December 7, 2021

The Rules Committee and Land Use & Housing Committee will be the last committee meetings of the calendar year.  Rules will feature further discussion on a proposed ballot measure regarding Project Labor agreements.  LU & H will consider a joint use agreement to move a gas pipeline in the UTC area.  Committee members will also decide on termination of a lease that formerly housed Downtown Johnny Brown’s bar and grill in Civic Center Plaza and changes to cannabis regulations.

Ballot proposalItem 1 - Further Consideration of a Proposed Ballot Measure regarding the San Diego Municipal Code Article 2 Division 44 to Amend the City’s Contracting Policies (Safeguard San Diego), per Council Policy 000-21 for the November 2022 Ballot – This item continues discussion of a ballot measure proposed by Councilmember Campillo and Council President Pro Tem Whitburn regarding amendments to the San Diego Municipal Code Article 2 Division 44 for the November 2022 ballot.  The Safeguard San Diego ballot measure will update City contracting policies, provide the City the choice to enter into Project Labor agreements, and to ensure no infrastructure funding is left on the table. Outdated City contracting policies has put the City at risk of losing millions of dollars in infrastructure funding.

GaslineItem 1 – Authorization to enter into a Joint Use Agreement with San Diego Gas & Electric Company for use of a portion of public Right of Way known as Eastgate Mall – A resolution authorizing the Mayor or his designee to enter into a Joint Use Agreement with SDG&E for the relocation of a 10-inch gas main from the current easement location on City[1]owned property to the adjacent City street, Eastgate Mall. SDGE’s current estimate for the work to move the gas line into the JUA is approximately $10 million.  R-312063, passed by City Council on November 15, 2018, authorized a payment of $35,678,521 to SDGE for the design and relocation of existing gas and electric utilities to accommodate Pure Water Phase 1 projects. SDGE’s actual costs for this relocation will be deducted from this lump sum payment as costs are incurred.

 

 

 

Johnny BrownsItem 2 - Lease Surrender and Termination Agreement with American Institute of Architects San Diego Chapter for City-owned property located at 1220 Third Avenue, San Diego, CA 92101 – This item would authorize the City to terminate the City of San Diego Non-profit Flat Rate Lease between the City of San Diego and American Institute of Architects San Diego Chapter, prior to the current lease’s termination on July 31, 2029.  Upon termination of the Lease, transfer of the assets and any improvements will be assumed by the City.  Staff is currently re-evaluating the site for potential City uses and, if it is determined the City does not have a use, will initiate a competitive solicitation process. 

 

 

 

CannabisItem 3 – Amendments Related to Cannabis Outlets – California recently updated its cannabis regulatory structure by consolidating the work of three different state programs into a single state agency called the Department of Cannabis Control (DCC). DCC is responsible for the licensing, inspection, enforcement and regulation of all cannabis activities in California. Prior to the issuance of a state license, cannabis businesses must first obtain approval from their respective local jurisdiction as part of DCC’s dual-licensing process. The proposed amendments are intended to make the City and State regulations align. These amendments mainly address differences in operating hours, types of sensitive uses and the distances from those types of uses.
