Proclamations

Item 30 – Juneteenth Day

This proclamation honors the oldest known celebration that commemorates the official end of slavery in the United States.

Item 31 – World Refugee Day

This item recognizes the strength, courage, and resilience of refugees around the world who have been forced to flee their homes due to conflict, persecution, and violence.

Item 32 – Paul Downey Day

This proclamation recognizes for recently retired CEO of Serving Seniors after 30 years of service.

Item 33 – Dennis Otsuji Day

This item honors the planning commission for nearly 16 years, serving twice, from 2004 to 2012 and from 2017 to 2025.

Item 34 – Sergeant Thomas Carlyon Day

This item celebrates the San Diego Police Sergeant for his 29 years and 9 months of distinguished service to the residents of San Diego.

Item 501 – Richard Miller Day

This item recognizes the volunteer who has served the Sierra Club for 25 years.

Item 508 – Kimberly L. Knox Day

This proclamation honors the San Diego City Employee with over 36 years of dedicated service.

Item 509 – Salome Court #1 Centennial 100th Anniversary Day

This item celebrates a women’s group which has over 100 years of continuous service to uplift, empower, and support underserved communities.

 

Consent Agenda

20 items fill the Consent Agenda including Appointments to the Commission on Arts and Culture and Declaring a Continued State of Emergency Regarding Raw Sewage, Solid Waste, and Sediment coming from Tijuana, Mexico.

 

Discussion Items — to be heard at the 2 p.m. session

Item S500 – Ordinance Adopting Updated SDPD Military Equipment Use Procedure, and Renewing Approval for Use, Funding, and Acquisition of Military Equipment, Under Assembly Bill 481

On September 30, 2021, the Governor of the State of California approved Assembly Bill 481 requiring law enforcement agencies to obtain approval of the applicable governing body (Mayor and City Council), by adoption of a military equipment use policy, prior to acquiring, seeking funding for, continuing to use, or collaborating with another law enforcement agency in the use of military equipment, as defined.

In 2024, with Council’s approval, the San Diego Police Department acquired new military equipment. New equipment described in the updated procedure includes:

  1. Sound Moderating Muzzle Attachment
  2. Long Range Acoustic Device (LRAD)
  3. 40MM Launchers
  4. Infrared Sighting Systems
  5. Night Vision Optical Devises

This item would approve an Ordinance adopting the Police Department’s updated Military Equipment Use Procedure and renewing approval for use, pursuit of funding for, and acquisition of military equipment under Assembly Bill 481.

 

Item 331 – Proposed Fiscal Year 2026 Recreation Center Fund and Opportunity Fund Budgets

This item seeks City Council approval of the Fiscal Year 2026 proposed budgets for Recreation Center Funds and allocations of the Opportunity Fund, which allow for additional recreation programs, maintenance, and events to take place.

 

Item 332 – Adoption of Resolution of Necessity to Commence Eminent Domain Process to Acquire a Permanent Easement and Temporary Construction Area Easement for the Murphy Canyon Trunk Sewer Repair/Rehab Project, CIP Project B-17005

The Murphy Canyon Trunk Sewer Repair/Rehab Project (Project) will increase the capacity and service demands of the sewer system within the Tierrasanta, Kearny Mesa, Mission Valley, and Serra Mesa Communities.

The City proposes to acquire portions of property owned by Daley Square Dolphin located at 3755 Murphy Canyon Road, San Diego, California, which is needed to construct the Project. To date, staff has been unsuccessful in reaching an agreement with the Owner regarding the value of just compensation for the property interests to be acquired, and negotiations are at an impasse.

Rather than continue negotiations with staff, the Owner filed an inverse condemnation action against the City claiming pre-condemnation damages for the City’s purported delay in proceeding with an eminent domain action.

Staff is therefore requesting authority to commence an eminent domain proceeding to acquire the property interests necessary for this important public project and to ensure timely possession of the property interests in advance of an award of the construction contract for the Project.
