Item S500 – Margaret Leinen Day

This item recognizes the scientist who has led the Scripps Institution of Oceanography, elevating the organization to worldwide recognition and advancing earth science research for a sustainable future.

Item S503 – Ordinance Regarding Residential Tenant Utility Charges

The City of San Diego charges for City-provided services such as water and wastewater. The City may also soon implement a cost recovery fee for solid waste management services resulting from the passage of Measure B (2022), which voters approved in 2022 and allows the City to implement cost recovery for solid waste management services. 

Since then, City staff have worked diligently to implement Measure B, which will allow the City to advance toward its Zero Waste and Climate Action Plan goals, end a longstanding inequity, and allow for more investment in public services and programs.

The proposed ordinance intends to: 

  • Prohibit property owners from overcharging their tenants for City-provided utility services, inclusive of water, sewer, stormwater, and solid waste management services.
  • Create transparency with property owners that utilize third-party billing services.
  • Establish a tenant’s right to request and view itemized charges levied on them by a property owner.
  • Establish enforcement and remedies for violations.

Item S501 – Ordinance Amending the Municipal Code Relating to Grocery Pricing Transparency

On April 15, 2025, the City of San Diego adopted the Grocery Pricing Transparency Ordinance to improve price transparency and access to discounts in grocery stores, especially for residents unable to access or navigate digital coupon systems. The ordinance requires grocery retailers to provide printed versions of digital coupons upon request and to post signage notifying customers of their right to such alternatives.

In response to feedback from stakeholders, including grocery retailers, consumer advocates, and senior rights organizations, a set of amendments is now proposed to enhance clarity, support implementation, and allow for flexibility in compliance. These changes aim to preserve the ordinance's consumer protection goals while addressing practical implementation concerns raised during initial rollout discussions.

Proposed Changes Include:

  • Would not apply to digital discounts offered to individuals by or through grocery store loyalty programs, subscription services, or paid membership programs
  • Delay implementation until October 1, 2025
  • Would exclude grocery stores that operate exclusively online through the Internet and do not have a physical presence in the City

     

Item 330 – Consideration of Nominees for Appointment to the Commission on Police Practices

This item is the consideration of appointments to the Commission on Police Practices. There are currently 10 vacant seats for consideration. For the categories where there are more nominees than vacancies, the City Council will appoint through a balloting process.

Item 331 – Public Right-of-Way Vacation for 3407 E Street – PRJ-1106328

This item would adopt a Public Right-of-Way Street Vacation for an improved 0.21-acre portion of an existing 60-foot-wide portion of 34th Street located south of the intersection of E Street and Sunrise Street in the Southeastern San Diego community planning area.

The vacated street would revert to the abutting parcels’ underlying fee owners, 3407 E Street, LLC to the east and Sunrise Property Investments, LLC to the west (Figure 2). These LLCs are under the same property ownership and management.

 

Item 332 – Easement Vacation for 5322 Alta Bahia Court – Project No. PRJ-1113835

This item would adopt an easement vacation to vacate 14,698 square feet of slope easement, on a 0.82-acre project site located at 5322 Alta Bahia Court.

The project proposes the vacation of an approximate 14,698-square-foot slope easement for earth excavation or embankment slope (slope easement), on a 0.82-acre site located at 5322 Alta Bahia Court.

The site is located in northeastern Pacific Beach area and has an existing 2,905-square-foot single dwelling unit with an attached two-car garage. Access to the site is via a 110-foot-long driveway from Alta Bahia Court.

The existing slope easement was originally acquired for the construction of Fanuel Street (currently Cardeno Drive) as shown in Map No. 5862. The slope easement is no longer required since the roadway width of Cardeno Drive is approximately 40 feet within a 74 to 84 feet of right-of-way, and it has been constructed to its intended street classification of a two-lane collector street as identified in the City of San Diego Street Design Manual and the Pacific Beach Community Plan.

No development or site improvements are proposed.
