Item S502 – Proposed Amendments to the City of San Diego’s Earned Sick Leave and Minimum Wage Ordinance to Enhance the City’s Ability to Combat Wage Theft and Align the City’s Earned Sick Leave Requirements with Existing State Law
This item would adopt an Ordinance amending Chapter 3, Article 9, Division 1 of the San Diego Municipal Code by amending Sections 39.0104, 39.0105, 39.0106, 39.0107, 39.0112, and 39.0113 related to the City of San Diego Earned Sick Leave and Minimum Wage Ordinance.
Wage theft is a widespread and underreported form of economic harm affecting workers across San Diego, often occurring at a scale that rivals other forms of theft. It takes many forms, depriving workers of wages and benefits they have legally earned. Data from the U.S. Department of Labor underscores the scope of the issue, with significant amounts of unpaid wages recovered each year, while many violations still go unreported.
The City of San Diego adopted the Earned Sick Leave and Minimum Wage Ordinance to provide protections for individuals who perform work within the geographic boundaries of the City. Among other things, the ordinance currently provides for a higher minimum wage than under California law. Strengthening enforcement and aligning the City’s ordinance with existing State law is essential to address the systemic problem of wage theft, protect workers in the City, and to ensure accountability.
