The contract approved installing smart streetlights and pairing Ubicquia’s UbiHub AP/AI unit with Flock Safety’s ALPR Technology. However, several concerns have been raised by the City of San Diego Privacy Advisory Board and Council regarding this contract.
This item seeks to direct the City Attorney to draft a resolution to rescind Council approval of the ALPR Use Policy and amend the Trust Ordinance to prohibit the use of ALPR Technology.
Item 3 - Cannabis Delivery Service Permit Fee
The Office of the City Treasurer requests approval of a Cannabis Delivery Service Permit fee. The establishment of this fee is for the purpose of recovering costs associated with administering the issuance of the Cannabis Delivery Service Permit. This Council action initiates the process to form a new maintenance assessment district (MAD), to be known as the “Ocean View Hills Zone A Maintenance Assessment District”, located in the Otay Mesa Community Planning Area. The District would receive oversight from the Parks and Recreation Department.
Tri Pointe Homes IE-SD, Inc., the sole property owner, has petitioned the City for the formation of the District. Properties located in the District will receive sole direct access via the streets and parkways containing various landscaped and hardscaped assets maintained by the MAD.
The District would fund services and activities over and above the standard baseline services currently provided by the City.
Item 3 - Request for Proposal (RFP) 10090440-26-G, As- Needed Tree Maintenance Services
This action requests the approval of a resolution to authorize the City to execute a contract for As Needed tree maintenance services between the City of San Diego and West Coast Arborist, Inc., for a not-to-exceed amount of $30,000,000 with an initial contract term of five (5) years.
This agreement is required to provide As-needed tree maintenance services for the Parks and Recreation and Transportation Departments.
Item 4 - Amendments to the San Diego Municipal Code Chapter 6, Article 3, Division 00 Related to Boat Beaching Bar Areas in Mission Bay Park
This item would amend the San Diego Municipal Code to define and change the use of Boat Beaching Bar Areas in Mission Bay Park. This action is intended to implement Recommendation 1.3 of the City Auditor’s Hotline Report of Boat Storage Permits.
The Office of the City Auditor received a Fraud Hotline allegation regarding the mismanagement of permits issued by the City for the long-term storage of small boats on the shoreline of Mission Bay. On November 20, 2024, the City Auditor presented the results of their investigation into this hotline allegation to the Audit Committee.
To address these concerns, the City Auditor’s Hotline Report of Boat Storage Permits made 10 recommendations to improve the City’s boat storage permit administration, facilities, fee recovery, and compliance operations. Parks and Recreation and Fire-Rescue department management agreed to implement all 10 recommendations.
Item 5 - Update to Beach Mooring Fee and Bar Fees
In November 2024 the City auditor conducted an Audit based on a Hotline Report of Boat Storage Permits. In this report a number of items were concluded:
- Various permits were not issued due to clerical issues resulting in various people on the waitlist;
- The City charges lower fees for boat storage compared to other jurisdictions;
- other jurisdictions are more efficient with storage options, and permits vary and the city could use more storage capacity;
- program compliance will need to be improved.
Per City Council Policy 100-05, the City performs a comprehensive user fee study every three to five years. User Fees shall be reviewed annually relative to the reasonableness of the fee and the fiscal effect as it relates to deterrence or other factors.
The department proposes updating the Beach Mooring and Beach Bar fees, classified as Category 1 and Category 3 fees, to achieve full cost recovery and align the current rates with market conditions and those of other municipalities.
Item 6 - Amendments to the Short-Term Residential Occupancy Ordinance
This item would adopt the ordinance amending Chapter 5, Article 10, Division 1 and Division 2 of the San Diego Municipal Code relating to Short-Term Residential Occupancy.
The proposed amendments are intended to clarify and strengthen the City's existing Shor Term Residential Occupancy regulations based on the City's experience administering the program. The amendments do not replace the existing regulatory framework. Rather, they provide greater clarity regarding primary residence requirements, license applications and renewals, host responsibilities, neighborhood protections, enforcement, and hosting platform reporting.
