Three committees meet this week. Rules will have an initial review of a proposed vacation home operation tax. Community and Neighborhood Services considers appropriations for development impact fees. Item 1 – Approval of Committee Minutes

 

Item 2 - Second amendment to contract 10089693-21-S, Electronic Filing System

This council action would authorize a time extension and increase of the total compensation of the electronic filing system (EfileSD) contract 10089693-21-S with Pasadena Consulting Group LLC. The time extension will add an additional year of service, for a total of six years. This action will also increase the total compensation from $330,000 to $392,000 to provide the funds needed for the one-year extension of the Contract.

Item 3 - Updates to Council Policy 000-26, "City Funds Commission Reports"

Council Policy 000-26, “City Funds Commission Reports,” was originally adopted in 1983. Since then, additional funds have been added to the Funds Commission’s oversight. This item seeks to update the Council Policy to modify the frequency of reports, request information on fund expenditures, and other clean up.

This item recommends that the Council President’s Office work with the City Attorney’s Office to draft a resolution to update Council Policy 000-26 for consideration by the City Council.

 

Item 4 - Initial Committee Review Of A Ballot Measure Proposal By Councilmember Sean Elo-Rivera Regarding a Vacation Home Operation Tax to Preserve Housing

This item requests that the Council District 9 office work with the Independent Budget Analyst and the Office of the City Treasurer to furnish background information and provide preliminary fiscal and operational analyses of the proposal, and work with the City Attorney’s Office to prepare ballot measure language and return to the Rules Committee for further consideration.

Councilmember Sean Elo-Rivera proposes a Vacation Home Operation Tax to Preserve Housing, which is detailed in the ballot proposal memorandum. The proposal is for a general tax ballot measure on the operations of vacation homes to be placed on the June 2026 ballot in the City of San Diego.

This tax would not apply to homes being used as owner-occupied primary residences or long-term 2 rental properties. There will be additional exemptions to avoid unintended consequences for San Diego residents.

Councilmember Elo-Rivera’s office has begun the process to develop a legal and operational framework for the ballot measure and the tax through discussions with the City Attorney’s Office, Independent Budget Analyst, and the Office of the City Treasurer.

Item 5 - Presentation from the Funds Commission, Council Policy 000-26

In accordance with Council Policy 000-26, the Funds Commission (Commission) will provide an update to the Committee regarding the status of the funds being supervised by the Commission.

Section 41(a) of the City Charter established the Funds Commission; the Commission has supervision and control over all trust, perpetuity, and investment funds of the City which are placed in its custody. There are currently seven (7) funds under the supervision of the Funds Commission, which include the Cemetery Perpetuity Fund, Edwin A. Benjamin Memorial Fund, Effie E. Sergeant Memorial Fund, Gladys Edna Peters Memorial Fund, Jane Cameron Fund, Los Penasquitos Canyon Preserve Fund and Phillip L. Green Memorial Fund.

Item 2 - Approval of appropriation and expenditure of Citywide Library Development Impact Fee fund (DIF) to support construction activities for the City Heights Branch Library Performance Annex Improvement Project, CIP S-23013

This Council Action request seeks authorization for the Library Department to appropriate and expend Citywide Library DIF for the City Heights Branch Library Performance Annex Improvement Project for Phase 2 Construction in an amount not to exceed $899,000.

These funds will support construction activities and provide for grant-ineligible soft costs and Americans with Disabilities Act (ADA) improvements required for the Performance Annex to achieve full operational readiness and code compliance.

This requested appropriation of $899,000 was previously identified in the Fiscal Year 2026 Capital Improvement Program (CIP) Budget in the Anticipated Budget column of the City Heights Branch Library Performance Annex Improvement project page as a placeholder while funding balances were being determined with the Planning Department’s Facilities Financing Division and the Department of Finance.

This action seeks to finalize the funding transaction by budgeting the remaining funds in the City Heights Branch Library Performance Annex Improvement Project, CIP project, S-23013.

Item 2 - Request for an Extension of the Construction Contract # K-20-1911-DBB-3 with Burtech Pipeline Incorporated for the construction of the Balboa Park Pipeline Phase III Project

Charter Section 99 requires that contracts extending for a period of more than five years be authorized by ordinance subject to vote of the City Council. This request is for an extension of the Construction Contract K-20-1911-DBB-3 with Burtech Pipeline Incorporated for the construction of the Balboa Park Pipeline Phase III project for an additional 18 months.

 

Item 3 - Time Extension of Construction Contract (K-17-1456-DBB-3) with Steve P. Rados, Inc., and 5th Amendment to Consultant Agreement (H115417) with Lee and Ro Inc. for the Pump Station 2 Power Reliability & Surge Protection Project.

This requested action is to authorize the extension of the obligations with Steve P. Rados, Inc. (Contractor), under Contract K-17-1456-DBB-3, to extend the contract completion date from December 12, 2025, to December 31, 2027, to allow for project completion.

In addition, this action is to authorize execution of the Fifth Amendment to the Consultant Agreement H115417, with Lee and Ro, Inc., to extend the contract completion date from December 31, 2025 to December 31, 2027, for professional construction support services of the Pump Station 2 (PS2) Power Reliability & Surge Protection Project.

In addition, this action is to authorize execution of the Fifth Amendment to the Consultant Agreement H115417, with Lee and Ro, Inc., to extend the contract completion date from December 31, 2025 to December 31, 2027, for professional construction support services of the Pump Station 2 (PS2) Power Reliability & Surge Protection Project.

 

Item 5 - Reimbursement Agreement between City and SANDAG for construction of Imperial Avenue Bikeway Pavement Repair Project

This item is a reimbursement agreement for the payment of costs for the Imperial Avenue Bikeway project, which includes additional general travel lane pavement repair between the San Diego Association of Governments (SANDAG) and City.

 

Item 6 - Time Extension of Construction Contract (K-20-1914-EMR-3) with Otis Elevator Company, and authorization of Construction Change Order No. 4 for the Civic Center Plaza Elevator Emergency Modernization Project

Otis Elevator Company was given the notice to proceed with the construction contract (K-20-1914-EMR-3) for the Civic Center Plaza Elevator Emergency Modernization project on December 17, 2019. This action will approve an ordinance authorizing the extension of the obligations under Contract K-20-1914-EMR-3 through June 30, 2026, to allow for project completion.

Item 7 - Proposed Response to Grand Jury Report – “Never Been Challenged, City of San Diego Development Impact Fee Program Redux”

The referenced Grand Jury report includes nine findings and thirteen recommendations, of which all are directed to both the Mayor and City Council. The proposed joint Mayoral and Council response in IBA Report 25-33 – covers these findings and recommendations. The City’s response is due to the Presiding Judge of the San Diego Superior Court by November 26, 2025.

On May 30, 2025, the San Diego County Grand Jury filed a report, titled “Never Been Challenged, City of San Diego Development Impact Fee Program Redux.” This report raises concerns about the City’s compliance with the Mitigation Fee Act (MFA), including delayed and incomplete reporting, outdated community financing plans, and insufficient internal controls over Development Impact Fee (DIF) expenditures.
