Item S505 – Domestic Violence Awareness Month

Discussion Items — to be heard at the 10 a.m. session

Item S510 – Temporary Moratorium on Data Center Development, Establishment, Intensification, and Expansion

This action proposes the adoption of an urgency ordinance under California Government Code section 65858 to enact a temporary moratorium on the development of data centers in the City.

Data centers are not currently adequately regulated by City land use plans and regulations, present an immediate threat to public safety, health and welfare, and a moratorium provides the City with time to study, consider, and potentially adopt regulations to address whether, where, and under what conditions data centers should be allowed within the City.

Pursuant to Government Code section 36937(b), the temporary moratorium would take effect immediately upon its adoption by at least a four-fifths vote of the City Council and would remain in effect for 45 days from its passage. After noticing and holding another public hearing, the City Council may, with a 4/5 vote, extend the temporary moratorium for an additional 10 months and 15 days. No more than two extensions may be adopted.

Discussion and Information Items — to be heard at the 2 p.m. session

Item 330 – Public Hearing to Proposed Adjustments to Water Rates in Accordance with the Water Memorandum Modifying the 2025 Water Cost of Service Study (Stantec Memo).

This item is to hold a public hearing and vote on proposed adjustments to the City’s water rates that modify the rate structure from a tiered volumetric rate for Single-Family Residential customers to a unitary volumetric rate for all customer classes, together with the corresponding adjustments to the Base Charges and Private Fire Protection Charges, in order to bring the City into compliance with the final judgment in Daniel Patz et al. v. City of San Diego.

The proposed rate structure is set forth in the Water Memorandum Modifying the 2025 Water Cost of Service Study prepared by Stantec Consulting Services, Inc. and is based on the same total revenue requirement established in the 2025 Water Cost of Service Study. The proposed adjustments do not increase the overall revenue requirement previously approved by the City Council.

Protests were heard and tabulated during a previous meeting. Councilmembers will hear public comment and vote on the item.
