Hasia-Welch v. City of San Diego Information

The Superior Court of California has certified a class action lawsuit to litigate claims against the City of San Diego (“The City”) regarding allegations that parking violation notices did not comply with California’s Vehicle Code.

Plaintiff brought this lawsuit against The City alleging that The City did not adhere to California’s Vehicle Code, and that the Plaintiff and those similarly situated suffered loss of money from being assessed and/or paying unnecessary late fees for notices of parking violations and notices of delinquent parking violations that did not comply with the California Vehicle Code.

The Court has not determined whether Plaintiff or The City are correct. There is no money available now and no guarantee that there will be.

How do I know if I am affected by the case?

The Court has certified a class action lawsuit. You will be affected by the case if you are a Member of the Class, unless you excluded yourself. You are a member of the Class (“Class Member”) if you are a California citizen who:

  1. received a parking violation citation within the limits of the City of San Diego during the class period of February 25, 2022, through the first day of trial;  
  2. thereafter received a notice of delinquent parking violation; and  
  3. paid any late fees or penalties based on the notice of delinquent parking violation.

Excluded from the Class are:  

  1. The City of San Diego Office of the Treasurer, its officers, and directors at all relevant times, Members of their immediate families and their legal representatives, successors, or assigns, any entity in which The City of San Diego has or had a controlling interest;  
  2. Counsel for Plaintiff; and  
  3. the Judge and other officers of the Court presiding over this matter.

What is the lawsuit about?

The Plaintiff brought this lawsuit against The City, alleging that The City did not adhere to the California’s Vehicle Code, and that the Plaintiff and those similarly situated suffered loss of money from being assessed and/or paying unnecessary late fees for notices of delinquent parking violations that did not comply with the California Vehicle Code.

The City denies Plaintiff’s allegations and denies that Plaintiff and the Class Members are entitled to any relief. The Court has not determined whether Plaintiff or The City are correct.

Is there any money available now?

No money is available now because neither the Court nor a jury has decided whether The City did anything wrong, and the two sides have not settled the case. There is no guarantee that money or benefits will ever be obtained.

It’s important to note that any potential money available to the Class as a result of the Court’s decision would only be previously paid late fees, not the citations themselves. Citations would not be excused as a result of this action.

What will happen next in the case?

The Court has approved notifying the Class of this class action, and notices are being distributed to those determined potential members of the Class at this time. The case will proceed with discovery. A trial date has been scheduled for March 13, 2026.
