The People’s Business – September 8, 2022

Monday begins with a meeting of the Committee on SD Housing Commission Oversight and Reform.  At the afternoon City Council meeting, Councilmembers will vote on the appointment of Eric Dargan as Chief Operating Officer for the City.  They will also consider extending the COVID-19 Response and Recovery Committee and accepting $5 million in Federal funds or rental assistance.

Item 1 - Onboarding Manuals for Commissioners of the San Diego Housing Commission Board and Housing Authority – This item requests the San Diego Housing Commission create and onboarding manual outlining roles and responsibilities for Commissioners, identify San Diego Housing Commission Programs and, real estate under Housing Commission management, and training resources about applicable laws, including the Ralph M. Brown Act and the California Public Records Act.


 


 


 


Item 2 - San Diego Housing Commission’s Nonprofit Affiliate, Housing Development Partners – At the request of Committee Chair Councilmember Stephen Whitburn, the San Diego Housing Commission will provide an informational presentation about the Housing Commission’s nonprofit affiliate, Housing Development Partners.

Item 200 - Confirming the Appointment of Eric Dargan as City Manager (Chief Operating Officer) for the City of San Diego – The COO works to implement every priority area in the City’s Strategic Plan: Create Homes For All of Us, Protect & Enrich Every Neighborhood, Advance Mobility & Infrastructure, Champion Sustainability, and Foster Regional Prosperity.  This item is to confirm the appointment of Eric Dargan as the City Manager for the City of San Diego.


 


 


Item 201 - Extension of the Special COVID-19 Response and Recovery Committee Through Calendar Year 2022 – This action is requesting the extension of the Special COVID-19 Response and Recovery Committee through December 31, 2022 by amending Resolution 313437.


 


Item 202 - Approval of Agreement to Retain Jarvis Fay LLP to Provide Legal Services Relating to the Collection of Transient Occupancy Tax (TOT) and Tourism Marketing District Assessments (TMD) – This item would authorize the retention of Jarvis Fay as outside counsel to assist with or represent the City in various matters pertaining to the City’s collection of TOT and TMD on online travel company transactions on an as-needed, hourly basis.


 


housing-commission_logoItem 203 - Authorize the City to Accept Additional Federal Emergency Rental Assistance (ERA1) Funds Allocated by the U.S. Department of the Treasury and Expend These Funds to Repay the State of California’s Rental Assistance (SRA) Program Emergency Rental Assistance Short-Term Cash Flow Loan Awarded to the City  for the Housing Stability Assistance Program (HSAP) Managed by the Housing Commission – The City’s COVID-19 Housing Stability Assistance Program, managed by the San Diego Housing Commission, helps to pay rent and utilities for household with low income in the City of San Diego that experience financial hardship due to the ongoing COVID-19 pandemic. The U.S. Department of the Treasury has allocated $5,019,573.68 in additional federal Emergency Rental Assistance funds which were directly awarded to the City of San Diego.


 


Item 204 - Authorize Retention of The Law Offices of Dorn G. Bishop, APC, to Provide Legal Services Related to the Former Naval Training Center Boat Channel – The City Attorney’s Office requests that the City Council authorize the retention of The Law Offices of Dorn G. Bishop, APC to provide specialized legal services.  The firm would assist the City in evaluating whether and to what extent insurance coverage may be available under the City’s historical line of comprehensive general liability insurance policies to indemnify and defend the City against potential environmental liability claims in connection with the former Naval Training Center Boat Channel, and to pursue and manage insurance coverage.


 


Port of San DiegoItem S400 - Consideration of Nominee for Appointment to the San Diego Unified Port District Board of Commissioners – Using Council Policy 000-13, the Council may appoint one member of the public to serve as the City of San Diego’s representatives on the San Diego Unified Port Board of Commissioners for the term of January 3, 2023 – January 2, 2027.  Michael Zucchet is nominated for appointment by Councilmember Joe LaCava, Councilmember Jennifer Campbell, Councilmember Marni von Wilpert, Councilmember Raul A. Campillo, and Councilmember Vivian Moreno for the term.


 


Item S401 - Settlement of San Diego Housing Commission, et al., v. Jim Neil, et al., San Diego Superior Court Case No. 37-2021-0003306-CU-BC-CTL - This item is a settlement of the case San Diego Housing Commission, et al., v. Jim Neil, et al., San Diego Superior Court Case No. 37-2021-0003306-CU-BC-CTL, alleging claims by the San Diego Housing Commission, the Housing Authority of the City of San Diego and the City of San Diego against Jim Neil, Kidder Mathews of California, Inc., Kidder Mathews, Inc., RT San Diego, LLC and Chatham RIMV, LLC.  This pertains to the Housing Commission’s purchase of two hotel properties purchased with public funds, before which Neil purchased shares of stock in the parent company selling the Hotel Circle property.  The item seeks a refund of commissions paid and damages from Kidder and Neil.
