Land Development Code Updates in Process
The Land Development Code (LDC) contains regulations for the development and use of property, including zoning, subdivisions and other related land use activities. The City Planning Department monitors and continually updates the code to simplify and streamline the permitting processes, assure compliance with state and federal regulations, eliminate unnecessary barriers, redundancies and contradictions, and align the code with the City's climate, equity, and housing goals.

Current Single-Issue Updates
The City Planning Department processes single-issue updates and amendments to the LDC as needed. For various reasons, including time sensitivity and/or complexity, single-issue updates may be processed separately from a comprehensive code update.
Accessory Dwelling Unit (ADU) and Junior Accessory Dwelling Unit (JADU) Regulation Amendments
The City Planning Department is proposing amendments to the ADU Home Density Bonus Program along with amendments to the City’s ADU and JADU regulations to comply with state law, implement Assembly Bill 1033 to allow ADU homes to be available for homeownership, address setbacks in High and Very High Fire Hazard Severity Zones, and provide clarifications and technical corrections.
Why is the City Planning Department proposing all of these ADU Amendments at the same time?
On March 4, 2025, the City Council requested amendments to the ADU Bonus Program, urging expeditious action to address several concerns related to the program’s implementation. In response, the City Planning Department is proposing the Council’s request and additional amendments to the ADU regulations as part of a single action.
Comprehensively amending the ADU and JADU regulations, along with the ADU Home Density Bonus Program, creates an opportunity for a robust discussion on how the amendments can address several key issues, such as public safety, development size, and funding for neighborhood improvements. By adopting all amendments simultaneously, the City can provide greater regulatory certainty and avoid the confusion and delays of a phased adoption. This helps clarify both the location and regulatory requirements of ADU home development throughout the city.
By law, the City is required to coordinate amendments to its ADU ordinance with the California Department of Housing and Community Development (HCD). This proposal enables the City Planning Department to coordinate more effectively with HCD, ensuring that the timely implementation of the amendments aligns with the City Council’s goal for swift and efficient action.

Public Hearings
City Council
On June 16, 2025, the City Council approved the introduction of an ordinance to amend the Accessory Dwelling Unit (ADU) and Junior Accessory Dwelling Unit (JADU) Regulations. The Council moved staff’s recommendation with two revisions to the ADU Home Density Bonus Program:
- Revision to Table 141-03A: The Maximum Number of Permitted ADUs and JADUs on Single Dwelling Unit Lots.
- Lot areas 8,000 sq. ft. or less – 4 units
- Lot areas 8,001 sq. ft. to 10,000 sq. ft. – 5 units
- Lot areas 10,001 sq. ft. or greater – 6 units
- A revision to the Community Enhancement Fee Waiver to remove Moderate Income Opportunity Areas. This fee will now only be waived for deed-restricted affordable ADU homes made available to very low and low-income households located in High or Very High Resource California Tax Credit Allocation Committee Opportunity Areas.
The ADU and JADU Regulation Amendments are scheduled for a second reading before the City Council on July 15, 2025. If adopted, the ordinance will take effect 30 days after it is signed by the Mayor in areas outside of the Coastal Overlay Zone. The new regulations will not take effect within the Coastal Zone until they are certified by the California Coastal Commission.
Land Use and Housing Committee
On May 15, 2025, the City of San Diego's Land Use and Housing Committee advanced the proposed amendments to the City's Accessory Dwelling Unit (ADU) and Junior Accessory Dwelling Unit (JADU) regulations to the City Council. The Land Use and Housing Committee approved staff's recommendation (3-1) with an amendment to item 16 (ADU Home Density Bonus Development Scale) to utilize Option 2 related to development scale using a cap approach, and implement the following proposed amendments to Action Item 2 relating to the Community Enhancement Fee:
- Exempt ADUs that are deed-restricted to very low (30%-50%) or low-income (30%-60%) households from paying the Community Enhancement Fee in Moderate, High, and Very High Opportunity Areas as determined by the California Tax Credit Allocation Committee; and
- Add requirements to the Community Enhancement Fee resolution to model it after the Climate Equity Fund.

Planning Commission
On May 1, 2025, the City of San Diego’s Planning Commission advanced the proposed amendments to the City’s Accessory Dwelling Unit (ADU) and Junior Accessory Dwelling Unit (JADU) regulations to the City Council Land Use & Housing Committee. The Planning Commission requested a two-story height limit and requested staff to present different options to the City Council regarding development scale, including but not limited to a unit count or cap, an alternative FAR to the zone, or a minimum size for the ADU Home Density Bonus Program.
